La notion véhiculée par «notwithstanding» peut ou non avoir à se rendre, selon le contexte. Le terme «notwithstanding», qui équivaut notamment, selon le cas, à «nonobstant», «malgré», «par dérogation à», «indépendamment de» ou «par exception à», peut véhiculer une notion dont il semble parfois inutile de faire état. Dans ce cas, le traducteur ou le rédacteur travaillant à partir de l'anglais aura intérêt à revoir la question avec le rédacteur anglophone en vue de la suppression éventuelle de la notion.
