Although there are many executory contracts equity will not enforce specifically, contracts for the sale of land have generally been held to be specifically enforceable. Maitland had said that "specific performance applies to agreements for the sale or lease of land as a matter of course" and this conclusion has been reiterated by the Supreme Court of Canada. The traditional view that ordinarily damages would not be an adequate remedy for breach of a contract for the sale of land is based on the assumption that each parcel of land is unique and thus damages would not permit the plaintiff purchaser to find a substitute.(Anger and Honsberger, 2nd, p. 1153)

A when-issued treasury bill is a contract either to purchase or to sell the treasury bills that are to be auctioned at the next weekly tender.... For example, the when-issued market allows an investor to acquire a position before the treasury bill offering for an assured amount and at an assured rate, a course that may be preferred to waiting for the auction itself or until after the auction. The when-issued market also allows a participant to create a short position by selling the bills before they have been auctioned.

subsequently the company made what it described as a "sympathetic claim" for reimbursement of additional expense incurred among other things, "We have of course signed this contract and as such recognized your right to refuse these overruns". The additional expense... was attributed to the incompetence of a subcontractor recommended by the department who had to be replaced during the performance of the contract.
