The lost modern grant is the second stage in the history of acquisition of an easement by presumed right.... As the basis for prescription at common law was the presumption of a grant which the law assumed to have been made prior to 1189, the difficulty in establishing a prescriptive title at common law was evaded by the court adopting the fiction that a grant in comparatively modern times would be presumed.(Anger & Honsberger, 2nd ed., 1985, p. 937) 1, record 15, English, - lost%20modern%20grant

Statutes of Limitation are generally regarded as a means of protecting the defendant against a stale or unjust claim. Except in actions chiefly concerned with real property, in which, by the judicial interpretation of the limitation provisions applicable thereto, it has been held that the lapse of the statutory period operates to extinguish the right, "The Limitations Act" operates merely as a bar to the remedy by proceedings in the courts. Except where the statute by its terms absolutely extinguishes the debt or demand itself, the general rule with respect to debts, or more money demands is that statutes of limitation are regarded as barring the remedy, and not as extinguishing the cause of action. "Ad medium filum viae" Rule... At common law, where the boundary between A's land and B's land is a road, there is a presumption that, in the absence of evidence to the contrary, each owns the road up to an imaginary line or thread drawn along the centre of the road; the respective ownership of A and B is said to be "ad medium filum viae".(Di Castri, Registration of Title to Land, 1987, p. 18-789). 1, record 18, English, - ad%20medium%20filum%20viae%20rule
