The standard of care adopted by negligence law is an objective one. The courts utilize the fictional reasonable person to assist them in the task of evaluation. The words "fault" and "blame" are employed, but there is no moral opprobrium attached to this language as there is in the criminal law. These terms have acquired a special meaning in negligence law which varies in accordance with the class of defendant involved. 1, record 2, English, - blame

2, record 2, French, - bl%C3%A2me

... it is for the court to lay down the general standard of care exacted by law .... This will ordinarily take the form of an incantation of the traditional formula of the reasonable and prudent man. In a few situations, however, the legal standard of reasonable conduct has been defined with greater precision. E.g. the care which an occupier must observe for the safety of persons who have come upon his land has been meticulously formulated in accordance with a fine graduation of standards corresponding to the degree of benefit which he derives from their visit. 2, record 5, English, - legal%20standard%20of%20reasonable%20conduct

A certain latitude is allowed when "in the agony of the moment" (a person) seeks to extricate himself from an emergency not created from his own antecedent negligence. The degree of judgment and presence of mind expected of the plaintiff is what would have been reasonable conduct in such a situation, and he will not be adjudged guilty of negligence merely because, as it turns out, he unwittingly took the wrong course. 1, record 6, English, - reasonable%20conduct
