In conveyances, mortgages and many other assurances of corporeal hereditaments, numerous words descriptive, not only of every kind of easement, privilege or appurtenance, supposed to be capable of belonging to the property assured, but also of portions of the soil, fixtures and produce of the land(as timber) were, prior to the "Conveyancing Act, "1881, added to the parcels or description of the property, and were called the "general words. "They were useful when there were any easements or privileges reputed to belong to the property, although not legally appurtenant to it, as they would not have passed with the property unless expressly mentioned. The phrase "statutory easement" is not a term of art but it provides a convenient label under which to discuss various types of rights which owe their origins to statute and can be conveniently described as easements-whether because of their more or less close resemblance to easements arising from the acts of parties or because they are, whatever their lack of such resemblance, called "easements" by the statutes which create them.(Jackson, 1978, p. 189). 1, fiche 24, Anglais, - statutory%20easement

The lost modern grant is the second stage in the history of acquisition of an easement by presumed right.... As the basis for prescription at common law was the presumption of a grant which the law assumed to have been made prior to 1189, the difficulty in establishing a prescriptive title at common law was evaded by the court adopting the fiction that a grant in comparatively modern times would be presumed.(Anger & Honsberger, 2nd ed., 1985, p. 937) 1, fiche 50, Anglais, - lost%20modern%20grant

"Hostility" is the very marrow of adverse possession; it has even redundantly been called adversity. To say that possession is hostile should mean nothing more than that it is without permission of the one legally empowered to give possession, usually the owner. Any kind of permissive use, as by a tenant, licensee, contract purchaser in possession, or easement holder is rightful, not hostile. The better view is that unexplained possession is presumed hostile, so that it is up to the one who wished to do so to establish that it is rightful.(Cunningham, Stoebuck, Whitman, 1984, p. 760) 1, fiche 56, Anglais, - hostile%20possession

While all easements may be terminated by an act of the parties or by operation of law, they may initially be created of different durations. Thus, an easement may be created for a specified period of time, such as for a term of years or months, or for the life of either the owner of the servient or dominant tenement, or, if the easement is one in gross, for the life of the person in whose favor the easement exists.(Cartwright, 1972, p. 301). 1, fiche 63, Anglais, - easement%20for%20years

It has been described as a right annexed to land which permits the owner of the dominant tenement to require the owner of the servient tenement "to suffer or not to do" something on such land.(Anger and Honsberger, 2nd ed., 1985, p. 925). 1, fiche 72, Anglais, - easement

In the phrase "ancient lights", the word "lights" refers to apertures that admit light. "Ancient lights" are windows(or, e. g., skylights) which have been in position for a considerable period and to which an easement of light is therefore likely to have been acquired by prescription.(Riddall, 3rd, p. 293-294) 1, fiche 79, Anglais, - ancient%20lights

Many important wildlife habitats are found on private properties, such as cottages, woodlots, ranches and farms. The people who own these lands play an important role in protecting such habitats by limiting certain activities and practices, and encouraging restoration and stewardship. But what happens if they can no longer care for their property, or it passes out of their hands? Since 1995, Environment Canada's Ecological Gifts Program has enabled individual and corporate landowners to protect their cherished piece of nature forever by donating ecologically sensitive land to an environmental charity or government body. An "ecogift" can be a donation of land or a partial interest in land-such as a conservation easement, covenant or servitude. In addition to the peace of mind of knowing that the land will be managed by the recipient according to mutually agreed-upon conservation goals and objectives, donors are also eligible to receive income tax benefits for their donation. 1, fiche 92, Anglais, - Ecological%20Gifts%20Program

If the dominant owner shows an intention to release an easement or profit, it will be extinguished by implied release. Mere non-user is never enough by itself : an intention to abandon the right must be shown.
