Necessity and proportionality have always been core principles of both branches of the jus belli principles that apply to both the authority to employ military force and the regulation of actual employment. However, in the jus ad bellum context, they have never before been viewed as principles to regulate operational and tactical execution. Instead, in that context they frame the legality of national or multinational resort to military force in self-defense. The Peace Agreement for Bosnia and Herzegovina was concluded on 21 November 1995 in Dayton(United States) and signed in Paris on 14 December 1995 by the Presidents of the Republic of Bosnia and Herzegovina, the Federal Republic of Yugoslavia and the Republic of Croatia. In former times International Law empowered States when war was impending, or at its outbreak, to lay an embargo upon all enemy merchantmen in their harbours in order to confiscate them. Further, enemy merchantmen at sea could at the outbreak of war be captured and confiscated, although they did not even know of the outbreak of war. As regards enemy merchantmen in the harbours of the belligerents, it became, from 1854, during the Crimean War, a usage followed by some countries that no embargo should be laid on them for the purpose of confiscating them, and that a reasonable time, so-called days of grace, should be granted them to depart unmolested; but no rule was in existence until the Second Hague Conference of 1907, which produced a Convention(VI.) The transfer of an enemy vessel to a neutral flag, effected before the outbreak of hostilities, is valid, unless it is proved that such transfer was made in order to evade the consequences to which an enemy vessel, as such, is exposed. There is, however, a presumption, of the bill of sale is not on board a vessel which has lots her belligerent nationality less than sixty days before the outbreak of hostilities, that the transfer is void. This presumption may be rebutted. Although ready to terminate the war through a treaty of peace, belligerents are frequently not able to settle all the terms at once. In such cases hostilities are usually brought to an end through so-called preliminaries of peace, the definitive treaty to take the place of the preliminaries being concluded later on. Such preliminaries are a treaty in themselves, embodying an agreement between the parties regarding such terms of peace as are essential. Preliminaries are as binding as any other treaty, and therefore need ratification. Art. 1 of Convention(III) Relative to the Opening of Hostilities of the Hague Conference of 1907 provides that the hostilities between the contracting powers "must not commence without previous and explicit warning, in the form either of a reasoned declaration of war or of an ultimatum with conditional declaration of war". Moreover, under Art. 2, the existence of a state of war must be notified to neutral powers without delay, and would not take effect in regard to them until so notified, unless it were clearly shown that they were in fact aware of the existence of war. In the absence of such a declaration the legal effects of the war date from the commencement of hostilities if these are an expression of hostile intent. Three different kinds of hospital ships are dealt with in The Hague Convention. ... when war breaks out between certain powers, each nation wishing to remain impartial should normally issue either a special or general declaration of neutrality. Such a declaration, however, is by no means absolute. A neutral state may, during the course of the hostilities, repeal, change, or modify its position of neutrality, provided that such alterations are in accordance with international law and are applied without bias to all belligerents. The most important of the rights that result from a declaration of neutrality is the right of territorial integrity. Belligerents may not use a neutral' s territory as a base of operations or engage in hostilities therein.
