In distinguishing between the ordinary and natural meaning and the innuendo meaning of words, the substantive law cannot be separated from the requirements of pleading and the rules of evidence. If it is contented that words are defamatory in their ordinary and natural meaning, it is not necessary for the plaintiff to plead more than the words themselves.... If, however, the plaintiff wishes to rely on any special facts as giving the words a defamatory or any particular defamatory meaning, he must plead and prove such facts, including, where necessary, any special knowledge possessed by those to whom the words were published which gives the words that meaning, and must set out the meaning in his pleading.... the meaning resulting from those facts gives rise to a cause of action separate from that arising from the words in their ordinary and natural meaning. Such an extended meaning is described as a "true" or "legal" innuendo. 2, fiche 2, Anglais, - true%20innuendo

Consultation with several on-line and hard copy English language dictionaries, disclose that the ordinary meaning of the term may include "the diversion of... money away from its rightful owner. "However, in all instances, the meaning may also include conduct which is done dishonestly, for personal gain... These common definitions support the Court's initial view, that the phrase "misappropriation of funds" is certainly capable in its natural and ordinary meaning, of being defamatory. 5, fiche 3, Anglais, - misappropriation%20of%20funds

A grant; it is applied to an estate either in fee or for a term of life or years, but most commonly to the latter; it is used in writs for any estate. The fact that the word "status" does not restrict the statute in the manner proposed by the appellants is clear from the way the term has been qualified in the case law, and in the submissions of the parties. The very issue in this appeal has been characterized as whether s. 5(1) of the Code includes complaints based on "relative status" as opposed to "absolute status". The essence of the appellants’ argument is that the ordinary meaning of the word "status" refers to an absolute condition; the inclusion of relative status within the scope of the definition would require the addition of a qualification. We cannot agree. The word "status" is equally capable of encompassing both the absolute definition and the relative definition. Moreover, the terms "marital status" and "family status" are in themselves relative. That is, they require the existence or absence of a relationship with another person. To restrict its meaning to the absolute would ignore the very condition that brings the status into being in the first place. 1, fiche 12, Anglais, - relative%20status

... strict liability will be imposed if two elements are present :(a) a non-natural use of land and(b) an escape.... 1. NON-NATURAL USE/The judges who first used the term "non-natural" would probably be surprised by the way it has been explained by later judges. Although the phrase was originally meant to underscore the notion that land, in its natural state, could not be the subject of tort liability, this was soon altered. The judges who opposed the idea of strict liability fastened on to the phrase "non-natural" and employed it, whenever possible, to exempt certain common ordinary activities from the operation of the rule,... non-natural came to mean special, exceptional, unusual, or out of the ordinary. In the same way, the word natural took on the meaning normal, common, everyday, or ordinary, rather than primitive or in a state of nature.

The test for identification is the same as for defamatory meaning : would a sensible reader reasonably identify the plaintiff as the person defamed? Here also the standard of reasonableness is not high : the ordinary reader of a newspaper article... is not expected to read "with cautions and critical analytical care"; he may read "casually and not expecting a high degree of accuracy" and indulge "in a certain amount of loose thinking" and even "rather far-fetched inferences". 1, fiche 17, Anglais, - standard%20of%20reasonableness
